Dissolution in Ohio

A dissolution is a simplified way to file for a divorce. To qualify to file for divorce or dissolution in Ohio, the petitioner(s) must have been a resident of Ohio for at least six months and a resident of the county in which they file for a minimum of 90 days before filing their petition. In a dissolution, both spouses must sign the petition and attach a separation agreement which includes, among other things, a division of property, a plan for spousal support, if any, a custody and visitation plan if there are minor children involved, and a child support worksheet. In the case of minor children, Ohio parents are required to also attach proof of having attended a mandatory parenting class.

Upon a date scheduled by the court, both parties are required to appear before a judge to agree that

1. each party voluntarily signed the separation agreement and dissolution petition
2. each party is satisfied with the terms of the agreement, and that
3. each party indeed seeks to dissolve the marriage.

Assuming that both parties agree to the dissolution, this method of divorce is much simpler, cheaper, and significantly faster than a traditional divorce proceeding. However, should the parties not be able to reach a mutual agreement that would facillitate a dissolution, Ohio law provides for divorce that is both contested and uncontested. For many couples, a dissolution is a far more reasonable, affordable, and amicable solution to divorce and provides a no-fault option during what is often a very stressful procedure.
